Northam Extends Healthcare Executive Orders

Gov. Ralph Northam has extended Executive Orders (EOs) related to the healthcare workforce and flexibility for Medicaid providers. EOs 57 and 58, which were set to expire on June 10 will remain in effect for the duration of the COVID-19 state of emergency  unless amended or rescinded. EO 57 addresses out-of-state licensees; EO 58 suspended screening requirements for hospital discharges to nursing facilities.

EO 57, originally signed on April 17, implements several policies designed to expand Virginia’s health care workforce to assist with the COVID-19 response. The order allows for the expanded use of telehealth and authorizes out-of-state licensees to provide in-state care at hospitals, nursing facilities, dialysis facilities, physician offices, and other health care facilities. Gov. Northam also extended EO 58, originally signed April 23, which suspended the Long Term Services and Supports (LTSS) screening requirements for all hospital discharges directly to a nursing facility for both skilled and long term care services retroactive to March 12, 2020 and for the duration of the COVID-19 emergency. Hospitals do not need to screen these individuals prior to discharge nor do nursing facilities need to obtain a screening prior to admission. The full text of amended EO 58 is available here.
