Comprehensive Revision to ALF Standards Published

The comprehensive revision to the Standards for Licensed Assisted Living Facilities, 22VAC40-73, was published as a final regulation on November 13, 2017. The full text of the revision can be found on in the Virginia Register of Regulations. The comprehensive revision has an effective date of February 1, 2018.

As a reminder, 22VAC40-72 is being repealed and replaced by 22VAC40-73.  The brackets indicate changes from the proposed regulation to the final. 

A public comment period for the ALF comprehensive revision is open during the 30-day final adoption period, beginning November 13, 2017 and remaining open through December 13, 2017.  Comments may be made on the comment forum on Virginia Regulatory Town Hall at https://townhall.virginia.gov or may be emailed to Judith McGreal, Program Consultant, Virginia Department of Social Services at judith.mcgreal@dss.virginia.gov.  All comments received during this period will be considered.

In addition to the comprehensive revision noted above, there is an exempt action for technical corrections to the ALF regulation, which is also published as a final regulation in the Virginia Register of Regulations, Volume 34, Issue 6 – November 13, 2017. The technical corrections incorporate the requirements for liability insurance disclosure and hospice care into the comprehensive revision, 22VAC40-73, and may be found on the Register’s website.  These requirements already had gone through the final adoption period and were in effect, but were based on the current ALF regulation, 22VAC 40-72. There is no current public comment forum for these technical corrections.
