The Virginia Department of Labor and Industry’s (DOLI) final permanent standard (FPS) is in now in effect. The DOLI Safety and Health Codes Board met August 26 and adopted as final revised amendments to the standard for COVID-19.

Key changes under the new amendments include:

• All employers now required to have a policy in place to ensure compliance with the FPS. This policy must include an anonymous reporting mechanism for employees to report violations.
• All health care settings are required to have an Infectious Disease Preparedness and Response Plan (IDPRP) by October 8, 2021.
• The same employers as above must provide training on the FPS and the IDPRP by November 7, 2021.
• Compliance with current CDC guidelines is now considered compliant with this FPS.
